Entertainer terms and conditions
These terms apply to every DJ, band, musician and agency listed on The Beat Exchange Aotearoa. Creating or holding a profile means you accept them. They sit alongside our terms and privacy and the requests board rules.
1. What we are, and what we are not
The Beat Exchange Aotearoa is a listing and introduction platform. We are not a booking agent, manager or employer. We do not take commission on your work and we are not a party to any agreement you reach with a customer.
You contract directly with the customer. You are responsible for your own pricing, contract, deposits, invoicing, tax, GST obligations, insurance and delivery of the performance.
2. Eligibility and your profile
- You must be 18 or over and legally entitled to work in New Zealand.
- One account per person or act. Linked profiles for variations of your act are created through your dashboard, within the limits of your membership tier.
- Everything on your profile must be true and current: your act, experience, equipment, coverage area, pricing and availability.
- You must own or have permission to use every photo, video, recording and logo you upload. You give us permission to display and promote that content on the site, in search results and in our emails and social posts.
- Profiles are reviewed before they go live. We can decline, edit or unpublish a profile at our discretion.
3. Verification and badges
- Identity, business, GST, insurance and other badges are granted only after we review the documents you supply.
- Supplying false, altered or borrowed documents is fraud. It results in immediate removal and, where appropriate, referral to the relevant authority.
- If a verification is declined on identity grounds, your account is placed on hold until it is resolved.
- You must tell us promptly if something changes: your business ceases, your insurance lapses, your GST registration changes, or you are charged with an offence relevant to working at public events or with young people.
4. Communication standards
Every message, estimate, board reply and interaction with a customer, another member or our team must be professional and respectful. The following are breaches:
- Abusive, threatening, harassing, intimidating or sexually inappropriate messages of any kind.
- Racist, sexist, homophobic, transphobic, ableist or culturally demeaning language.
- Repeated or unwanted contact, pressuring a customer for a decision, or contacting anyone who has not initiated contact with you.
- Attempting to move a customer off the platform to avoid our records, or soliciting customers you met here for other services or platforms.
- Sharing, publishing or reusing a customer's details, brief or conversation for any purpose other than the booking at hand.
- Disparaging another member, act, agency or venue, or misrepresenting another act's availability, pricing or reputation.
- Deliberately misleading a customer about price, inclusions, GST, travel, equipment or who will actually perform.
A confirmed breach of these communication standards results in immediate cancellation of your profile, without warning and without refund of any membership paid.
Messages sent through the platform may be reviewed by admin where a report or automatic flag is raised, so that we can investigate complaints and comply with New Zealand law, including the Harmful Digital Communications Act 2015.
5. Bookings and conduct at events
Bookings are made directly between you and the customer. We are not a party to that agreement and we do not manage your performance. How you deliver a booking is your responsibility:
- Respond to enquiries and estimate requests within a reasonable time, even if the answer is no. Persistent non-response affects your reply statistics and your standing on the platform.
- Keep your availability calendar accurate. Do not accept a booking you cannot deliver.
- Honour the price and inclusions you quoted. Do not add charges on the day that were not in your estimate.
- Turn up on time, appropriately presented, sober enough to perform safely and professionally, and with equipment that is safe and in working order.
- Cancelling a confirmed booking without a genuine emergency, or sending a replacement the customer did not agree to, is a serious breach.
- Follow the venue's rules, New Zealand health and safety obligations, licensing requirements and any noise or curfew conditions.
- Hold the licences and clearances your work requires, including music licensing where it applies and appropriate checks for events involving young people.
A complaint from a customer about how you delivered your services, including abusive behaviour towards a customer, arriving intoxicated, or failing to deliver what was booked, is treated seriously. Where a complaint poses a significant risk to the reputation of this platform, we may cancel your membership under section 8.
6. Ratings and reviews
- Do not create, buy, trade or solicit false reviews, and do not offer anything in exchange for a rating.
- Do not pressure or retaliate against a customer over a rating. Raise a concern with admin instead.
- Carried-over ratings from other platforms must be genuine and verifiable. We can remove any rating we cannot substantiate.
7. Membership, payment and terms
- Memberships are applied for through us and arranged directly, not paid through the website. Your tier and term are recorded in the system and shown on your dashboard.
- All advertised prices include GST. Your tier determines your features, including linked profile allowances and board access.
- We will remind you before your term ends. If a membership is not renewed, your profile reverts to the Starter tier and paid features stop.
- Fees already paid are not refunded where a profile is removed for a breach of these terms.
- We can change pricing and tier features with reasonable notice. Changes do not affect a term already paid for.
8. Suspension and cancellation
Depending on the seriousness of the matter, we may issue a warning, remove content, remove a badge, suspend your ability to reply on the board, suspend your profile, or cancel it permanently.
The following result in immediate cancellation:
- Breach of the communication standards in section 4.
- Harassment, threats, discrimination or abuse of any person on the platform.
- Fraudulent verification documents, identity or credentials.
- Taking payment for a booking you never intended to or did not perform.
- Conduct at an event that endangers or seriously distresses people present.
- A substantiated customer complaint about your conduct or delivery of services, such as abuse of a customer or arriving intoxicated, that poses a significant risk to the reputation of this platform.
- Repeated breaches after a warning.
You may close your profile at any time from your dashboard or by emailing us. Closing a profile does not release you from bookings already confirmed with a customer.
9. Liability
We provide the platform as is and do not guarantee enquiries, bookings or income. We are not liable for the conduct of customers or other members, for disputes over a booking, or for any loss arising from a booking made after an introduction here. Nothing in these terms limits rights that cannot be excluded under New Zealand law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 where they apply.
10. Privacy and data
We handle personal information in line with the Privacy Act 2020. Customer details supplied to you through the platform may be used only for that booking. You can request a copy or deletion of your own data at any time.
11. Changes and contact
We may update these terms. Material changes will be notified by email to the address on your account, and continuing to hold a profile means you accept the updated terms. These terms are governed by New Zealand law.
